• Design and supply contracts;

• Design-construct-maintain (DCM); or,

• Professional construction management contracts.

For your two selected contract methods you are to write a 1500-word essay that provides an outline of each contract type that discusses the following elements:

• A description of the contact that outlines the reporting relationship between the parties within the contract. 

In presenting this outline if there is a difference between the contract communication pathways and the way money flows between the parties within the contract you should provide explanation.

• Provide one example where this contract type has been used and explain how it could be used elsewhere in Civil Engineering projects.

• What are the troublesome areas in the use of this contract type? (You might investigate if there have been litigation issues raised in using this contract type.)

• Discuss whether you think a Civil Engineering degree is sufficient professional training for you to enact the contract. Justify your reasoning.

Part 2

Presently across the construction industry there are problems being experienced for jobs under contract where material shortages, rising interest rates, and changes to labour rates, has resulted in significant price hikes being experienced for the work under contract. 

In many instances construction contracts have been drafted without consideration of such industry price changes being anticipated and construction organisations are struggling with such a predicament.

You are required to complete a 1500-word essay that explains:

• What factors have made it necessary that building construction pricing has needed to be increased so rapidly?

• What are the options for Construction Contractors caught up in contracted work where price increases are being passed on to them by suppliers plus changer occuring in labour rates,

• How Construction Contractors should deal with Contract clauses for future construction work that provides them with a degree of safety in the pricing of their work that would allow them to pass on pricing increases to their client, and,

• How would you equitably measure these price increases to substantiate the need for a change in a contract rate for construction tasks being drafted for future contracted work?
